Welcome to the Ksheer application, managed and operated under licence by Dharampal Satyapal Ltd for the brand "Ksheer". By using this application or placing an order, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use this application. 1. Scope

This document establishes the general terms and conditions governing use of the Ksheer application and the purchase of products through it. "We", "us", "our" refers to Dharampal Satyapal Limited (DSL). "You", "your" refers to any natural or legal person accessing the application.

These Terms & Conditions are published under the requirements of the Information Technology Act, 2000 and the rules made thereunder.

3. Your Details & Visits

Information or personal details you provide shall be processed in accordance with these Terms & Conditions and our Privacy Policy. By using the application, you confirm that all information provided is true and corresponds to reality.

4. General Obligations

When you use this application and place orders, you agree to:

Use the application for legally valid enquiries and orders only.
Not make any false or fraudulent Login ID and/or orders.
Provide truthful email address, postal address, and other contact details.
Be over the age of 18 and legally eligible to enter into binding contracts.
Comply with local laws if accessing from outside India.

5. Formalising the Contract

To place an order, follow the online purchasing procedure and click "Authorise Payment". You will receive an Order Confirmation email upon successful payment, constituting a binding Contract between the parties. A Shipping Confirmation and E-ticket will follow.

6. Correcting Errors

You can modify personal data in the "Profile" section after registration. Errors during purchase can be corrected by contacting customer service at 0120-4032200 (Ext. 8056) or ksheer.support@dsgroup.com. If you detect an error after payment, contact us immediately.

7. Availability of Products

All orders are subject to availability. If a product is out of stock, we may offer a substitute of equal or higher quality. If you do not wish to order the substitute, a full reimbursement will be provided.

You may pre-book unavailable products. Once in stock, our associate will contact you within 4 days for confirmation. If we do not receive confirmation within that period, the pre-booked order will be deemed null and void.

8. Refusal to Process an Order

We reserve the right to remove any product from the application at any time and to refuse to process an order after sending an Order Confirmation in exceptional circumstances. We shall not be liable to you or any third party for exercising this right.

9. Delivery

We endeavour to deliver orders within a maximum of 4 days from the date of Order Confirmation. Delays may occur due to unforeseen circumstances or delivery zone limitations. Please verify your zone before placing an order.

If we are unable to comply with the delivery date, we will inform you and offer either a new delivery date or a full refund.

10. Cancellations & Returns

    Orders can be cancelled or modified before the daily cut-off time. Once dispatched, cancellations are not allowed. Due to the perishable nature of dairy products, returns are not accepted after delivery except for damaged, spoiled, or incorrect items. Customers can request a replacement or refund within 2 hours of delivery with proof. Refunds will be processed as wallet credit or via the original payment method.
  

11. Transmission of Risk & Ownership

Products become your responsibility from the moment of delivery. You take ownership once we receive full payment — including delivery charges — or at the moment of delivery, whichever is later.

12. Price & Payment

Prices will be as displayed on the application. Prices include GST but exclude delivery charges. If a pricing error is found, we will contact you to confirm at the correct price or cancel with a full refund.

Accepted payment methods: Visa, Mastercard, Rupay (debit/credit), bank transfer, mobile/internet banking, and UPI. Card details are encrypted. Payment is due immediately upon placing an order.

13. Invoice & Taxes

An online invoice is available in the 'Invoices' section of 'My Account'. All purchases are subject to applicable taxes including GST, duties, and cesses as per prevailing Indian regulations.

14. Intellectual Property

All trademarks, service marks, brand identities, trade names, graphics, designs, copyrights, and other properties on this application are protected intellectual properties licensed by DSL. They may not be copied, reproduced, uploaded, transmitted, or distributed in any way without express written permission.

15. User Submissions

Any feedback, suggestions, or comments submitted may be used by DSL without compensation. All submitted data must not infringe any intellectual property rights, violate any law, deceive or mislead others, impersonate another person, or contain harmful software or code.

16. Indemnity

You agree to indemnify, defend, and hold harmless DSL and its associate entities, directors, employees, and agents from all claims, damages, and expenses arising from your use of this application.

17. Limitation of Liability

In no event shall DSL or its directors, employees, agents, or suppliers be liable for any special, incidental, indirect, consequential, or punitive damages arising from your use of this application. Our liability for any product acquired is strictly limited to the purchase price of that product.

18. Viruses & Security

You must not introduce viruses, Trojans, worms, or other harmful material, nor attempt unauthorised access to our application or servers. Such actions will be reported to competent authorities and will result in immediate suspension of your access.

19. Events Beyond Our Control

We will not be liable for non-compliance caused by events beyond our reasonable control (Force Majeure), including strikes, civil unrest, natural disasters, government restrictions, or failure of public infrastructure. Our obligations will be suspended for the duration of the event.

20. Governing Laws

This application is intended for users in India only. The relationship between you and DSL shall be governed by the laws of India, subject to the exclusive jurisdiction of the courts at New Delhi, India.

21. Disclaimer

This application is owned and operated by Dharampal Satyapal Limited (DSL) on an "as is" basis. We disclaim any warranty of any kind, express or implied. We reserve the right to terminate these terms and restrict access to any user at any time without prior notice, as permitted under Indian Laws.

22. Waiving Rights

Our failure to require strict compliance with any obligation does not constitute a waiver of that right. A waiver is only effective if expressly stated in writing and communicated to you in accordance with these Terms & Conditions.
